Through a semiotic analysis of the binding character of laws, the first part of the book asks whether legal findings by a judge in a law-based democracy with a division of powers can be considered a rational undertaking (i.e. one claiming intersubjective correctness) or only a camouflage for the exercise of power. Part two pursues this question through a consideration of developments in criminal law doctrine.
